DMCA / Copyright Policy
How copyright owners can report infringing content on Wallper, and how users can submit counter-notices.
Overview
Wallper respects the intellectual property rights of others and expects our users to do the same. This DMCA / Copyright Policy explains how copyright owners (or their authorized agents) can submit a notice of alleged infringement, and how affected users can submit a counter-notice.
This Policy is intended to comply with the United States Digital Millennium Copyright Act (DMCA) and similar laws in other jurisdictions, including obligations under EU Directive 2019/790 where applicable.
Filing a Copyright Notice
If you believe that content available through Wallper infringes your copyright, please send a written notice to support@wallper.app with the subject line “DMCA Notice — Wallper”. Your notice must include the following information so that we can act on it.
- Your full legal name, address, telephone number, and email address.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
- Identification of the allegedly infringing material, including a direct URL or sufficient detail to allow us to locate it within the Service.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
- Your physical or electronic signature.
Our Response
- Upon receipt of a complete and valid notice, we will review the report promptly.
- If we determine that the content likely infringes copyright, we will remove or disable access to it and notify the user who submitted it.
- We may, where appropriate, take additional steps such as suspending the user’s license or banning repeat infringers.
- Incomplete or abusive notices may be ignored or rejected.
Counter-Notice
If you believe your content was removed or disabled in error or as a result of misidentification, you may submit a counter-notice to support@wallper.app with the subject line “DMCA Counter-Notice — Wallper”.
- Your full legal name, address, telephone number, and email address.
- Identification of the material that was removed or disabled and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your consent to the jurisdiction of the relevant courts and acceptance of service of process from the original complainant.
- Your physical or electronic signature.
Marketplace Submissions — Author Responsibility
When you publish a wallpaper on the Wallper Marketplace — whether it is offered for free or for a price — you are the publisher of that content and you are solely responsible for its legality. Wallper acts only as an intermediary hosting platform and does not pre-clear rights on your behalf.
By submitting a wallpaper for sale or free distribution through the Marketplace, you represent and warrant that you own all rights in the video, audio (if any), preview image and metadata, or that you hold a written license that permits commercial redistribution through Wallper to end users on macOS.
- You may not upload footage taken from films, TV shows, music videos, video games, stock libraries, AI-training datasets or other artists without explicit written permission from the rights holder.
- You may not use copyrighted characters, logos, brand assets or trademarks without a written license to do so.
- You are responsible for any taxes, declarations or fees that arise from selling your content on the Marketplace.
- You must keep accurate records of the licenses you rely on for at least the duration that the wallpaper remains available on Wallper, and provide them to us on request.
Enforcement on Marketplace Items
If a valid copyright complaint is received concerning a paid or free wallpaper you have published, we will take the following actions to comply with applicable law and protect buyers and rights holders.
- The wallpaper will be removed or disabled and delisted from search, categories and the buyer’s purchase flow.
- Any pending payouts attributable to that item may be withheld until the dispute is resolved.
- Where required, we may refund affected buyers and deduct those refunds from your available balance.
- Repeated or willful infringement leads to permanent suspension of your author account and forfeiture of any unpaid balance, as permitted by law.
- You agree to indemnify and hold Wallper harmless against any claims, damages, fines or legal costs arising out of content you published through the Marketplace.
Repeat Infringers
We maintain a policy of suspending or terminating the licenses and accounts of users who are repeat infringers. We may also restrict their ability to submit new wallpapers to the public gallery and to make new purchases.
Misuse of the Process
Submitting a knowingly false or bad-faith DMCA notice or counter-notice may expose you to liability for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA and similar laws. Please consult a qualified attorney if you are unsure whether the content in question is infringing.
