These Terms of Service (the “Terms”) govern your access to and use of Wallper, including its macOS application, companion website(s), APIs, and any related software, features, content, and services (collectively, the “Service”). The Service is operated by the Wallper operator identified in the Contact section (“Wallper,” “we,” “us,” or “our”).
By installing the app, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by any policies referenced herein (including our Privacy Policy). If you do not agree with these Terms, you must not use the Service.
If you accept these Terms on behalf of an organization, you represent and warrant that you have authority to bind that organization; in such case, “you” and “your” refer to that organization. These Terms apply to the maximum extent permitted by applicable consumer protection laws, which remain unaffected where they cannot be waived.
Eligibility
The Service is intended solely for individuals who are 13 years of age or older. By accessing or using the Service, you represent and warrant that:
You are at least 13 years old.
You are legally competent to enter into a binding contract.
If you are between 13 and the age of majority in your jurisdiction, you have obtained parental or legal guardian consent.
We do not knowingly collect personal information from children under 13; if we learn we have done so, we will take reasonable steps to delete it.
License and Payment Terms
Upon successful payment, Wallper grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Wallper application on up to three (3) personal macOS devices under your control.
Restrictions: You agree not to copy, distribute, sublicense, lease, or resell the software; circumvent license restrictions; share license credentials with unauthorized parties; or reverse engineer, decompile, or attempt to derive source code.
License revocation: We may suspend or revoke any license without prior notice in cases of Terms violations, fraudulent or abusive usage patterns, or security risks to our platform.
Refund policy: You may request a full refund within 14 calendar days of your original purchase date by contacting support@wallper.app and providing your order ID or transaction details. No justification is required. This policy does not affect statutory consumer rights.
User Content and Conduct
Wallpapers and other materials you choose to submit to the public gallery are treated as public content. Wallpapers stored and used locally on your device are private content.
Public content: You retain ownership of your IP; you grant Wallper a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, host, store, reproduce, resize, and distribute your content in connection with the Service. Submissions are manually reviewed; we may reject, block, or remove content at our discretion.
Private content: We do not collect, access, or process private wallpapers stored locally; we cannot retrieve, remove, or moderate such content; you are responsible for ensuring your use complies with applicable laws and IP rights.
Prohibited content (public and private): No pornographic/NSFW material; no content promoting hatred, violence, or discrimination; no racist or xenophobic propaganda; no content that violates law or regulation.
Service Availability and Modifications
We may modify, suspend, or discontinue any portion of the Service without notice.
We may introduce new features or discontinue existing functionality.
We may temporarily or permanently remove access to the public gallery or other community features.
We may perform maintenance or upgrades. We are under no obligation to maintain or support any feature indefinitely.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee the Service will be uninterrupted or error-free.
We do not guarantee that content will be available at all times.
We do not guarantee that uploaded files will be retained indefinitely.
Your use of the Service is at your sole risk.
Limitation of Liability
To the maximum extent permitted by law, Wallper and its affiliates, officers, employees, licensors, and service providers are not liable for certain categories of damages or losses.
No liability for indirect, incidental, special, punitive, or consequential damages.
No liability for loss of data, content, revenue, profits, or business opportunities.
No liability for incompatibility with third-party systems or software.
No liability for unauthorized access, loss, or alteration of your content.
Nothing here limits or excludes liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
Intellectual Property
All content on the Service (software, code, designs, interfaces, logos, trademarks, and visuals) is the exclusive property of Wallper or its licensors. Your use does not grant any rights or licenses under our or third-party IP.
You may not copy, modify, or create derivative works.
You may not distribute or redistribute any part of the software or website.
You may not reverse-engineer or attempt to extract source code.
Privacy and Cookie Policies
Your use of the Service is governed by our Privacy Policy and Cookie Policy. By using Wallper, you acknowledge that you have reviewed and agreed to these policies.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Ukraine, without regard to conflict of law principles. If you are in the EU, UK, or another jurisdiction with mandatory consumer protections, you retain all rights under such laws.

Changes to These Terms
We may update these Terms to reflect changes in practices, laws, or the Service.
